Tours Club India - Terms and Conditions

Welcome to Tours Club India. These Terms and Conditions govern all bookings, reservations, and travel services arranged by Tours Club India (operating as an independent private travel agency). By making a payment, receiving an itinerary, or confirming a booking voucher with us, you acknowledge and agree to be bound by the terms outlined below.

1. Independent Private Agency Status

Tours Club India is an independent, private travel agency offering comprehensive, customized tour packages, hotel reservations, and ground transport arrangements. We are not a government tourism department or official transport board. All operations and reservations are governed strictly by private contractual agreements between the client and Tours Club India.

2. Package Inclusions & Exclusions Framework

Standard Package Inclusions (Subject to specific itinerary details):

Hotel/resort accommodation on double/triple sharing basis as confirmed in your package voucher.
Meal plans (Breakfast/Dinner) as explicitly indicated in the booking confirmation.
All transfers, sightseeing, and inter-destination transit by comfortable private/shared tourist vehicles.
Toll charges, state transport entry permits, parking expenses, fuel costs, and driver daily allowances.
Assistance during transfers and check-ins at designated destinations.

Standard Package Exclusions:

Any services, meals, transfers, or extra sightseeing trips not specifically noted in the confirmed itinerary.
Personal expenses such as laundry, telephone calls, room service, alcoholic beverages, mineral water, and extra snacks.
Entry tickets to monuments, national parks, temple trust VIP pass fees (unless explicitly added), pooja materials, and camera charges.
Charges for porters, pony rides, horse rides, palanquins (palki), cable cars, ropeways, boat rides, or air/train fares.
Personal travel, baggage, or emergency medical insurance.
Any additional expenses arising from flight/train delays, roadblocks, landslides, or unpredictable natural disruptions.

3. Booking Confirmation & Payment Terms

To confirm and hold your travel dates, our payment schedule must be strictly observed:

Booking Advance: 30% of the total tour package cost is payable at the time of booking to secure hotels, transport, and dates.
Second Installment: 50% of the total tour cost is due 30 days prior to the travel start date.
Final Settlement: The remaining 20% balance must be fully cleared at least 10 days before departure.
Short-Notice Bookings: For tours booked within 15 days of the travel date, 100% advance payment is required at confirmation.
Confirmation Voucher: Upon receipt of advance payment, a formal booking confirmation voucher will be issued via email within 24 hours.

4. Guest Identification & Verification

All adult guests must carry and present a valid photo ID card (such as a Passport with Visa for foreign nationals, Voter ID, or Driver's License) at hotel check-ins and travel verification desks.
Hotels and service providers reserve the right to deny check-in if valid identification is not produced. Tours Club India is not responsible for any service refusal due to missing ID documents.

5. Hotel & Accommodation Rules

Check-in / Check-out: Standard hotel check-in time is 14:00 (2:00 PM) and check-out is 11:00 AM. Early check-in or late check-out is subject to room availability and may attract extra charges directly from the property.
Extra Bedding: For triple-sharing rooms, an extra mattress or rollaway cot is provided by the property according to standard hotel practice.
Heaters & Facilities: Room heater facilities, specialized laundry, and optional hotel amenities are subject to local power availability and may be charged directly by hotel reception.
Meals: Included meals are served as fixed buffets or fixed menus in designated hotel dining areas. Room service or à la carte items outside the set plan will be billed directly to the guest.

6. Vehicle & Transportation Terms

Point-to-Point Transport: Provided vehicles operate strictly according to the agreed itinerary. Vehicles are not on disposal for off-route personal journeys, late-night transit, or destinations outside the booked schedule.
Hill Station Driving & AC Rules: Vehicle air conditioning will be switched off while driving in hilly terrain, on steep inclines, or when stationary, to prevent engine strain and prioritize passenger safety.
Driver Working Hours: Daily driving duty is up to 12 hours. For passenger safety, night driving on mountain highways after sunset is restricted.
Traffic & Parking Restrictions: Due to local municipal restrictions, vehicles cannot enter pedestrian-only roads, narrow lanes, or Mall Road restricted zones. In such areas, guests may need to walk or hire local transport at their own expense.
Mechanical Breakdowns: In the rare event of a mechanical breakdown, we will arrange repairs or a replacement vehicle as soon as feasible. Your cooperation during such unpredictable transit delays is appreciated.

7. Cancellations, Refunds & Force Majeure

Detailed cancellation terms are covered under our dedicated Refund & Cancellation Policy. In summary:

Notice given 30 days or more prior to travel start date: 25% of total tour cost deducted.
Notice given between 15 to 30 days before start date: 50% of total tour cost deducted.
Notice given within 7 days of departure date: 80% to 100% of total tour cost deducted.
Force Majeure: Tours Club India is not liable for itinerary disruptions, flight/train cancellations, landslides, heavy snowfall, severe weather, roadblocks, strikes, or operational emergencies beyond our reasonable control. No refunds are applicable for unutilized sightseeing points or services impacted by such events.

8. Limitation of Liability

Tours Club India acts as a travel coordinator and booking agent facilitating arrangements between guests and independent third-party service providers (hotels, vehicle owners, transporters).
We are not responsible for any personal injury, illness, accident, loss of luggage, theft, or damage to property during the journey. Guests are strongly advised to purchase independent travel and medical insurance.

9. Jurisdiction & Governing Law

All contracts, bookings, and legal relations between the traveler and Tours Club India shall be governed exclusively by the laws of India. Any dispute, claim, or controversy arising out of or relating to this contract shall be subject to the exclusive jurisdiction of the competent courts in Dehradun / Haridwar, Uttarakhand, India.
