Tours Club India - Terms and Conditions
Please read these Terms and Conditions carefully, as they form the basis of your contract with Tours Club India. By booking with us, you agree to be bound by these terms. All email correspondence leading to a booking is also considered part of this contract.
1. Guest Responsibilities
- Identification: As per Indian government regulations, all guests (Indian and Foreign Nationals) must provide a valid form of photo identification at the time of check-in. Accepted documents include a Passport with Visa, Voter's ID card, or a current Driver's License. Hotels reserve the right to deny check-in if valid ID is not provided.
- Personal Belongings: Guests are responsible for their personal belongings throughout the tour. Tours Club India is not liable for any loss, theft, or damage to personal property in vehicles, hotels, or any other location.
- Medical Fitness: It is presumed that guests are medically fit to undertake the tour. Please inform us at the time of booking of any specific health conditions, allergies (especially food allergies), or mobility issues (e.g., difficulty with stairs), so we can make necessary arrangements where possible.
2. Accommodation Policy
- Check-in / Check-out: Standard check-in time is 14:00 (2:00 PM) and check-out time is 11:00 AM. Early check-in or late check-out is subject to availability and may incur additional charges unless explicitly included in your package.
- Extra Occupants: An extra mattress is often provided for an additional adult in a room, not necessarily an extra bed. Please specify your preference for an extra bed at the time of booking.
- Amenities: Charges for amenities like room heaters and Wi-Fi are not included in the standard package price. These are payable directly to the hotel if you choose to use them.
- Meal Plans: If meals are included, they are provided on a set menu or buffet basis as decided by the hotel. Any orders outside of the fixed menu (à la carte) will be charged separately. During periods of low occupancy, some hotels may offer a "meal credit" of a fixed amount instead of a buffet. Any amount exceeding this credit is payable directly to the hotel. Room service and packed meals usually incur extra charges.
3. Transportation Policy
- Vehicle Usage: The provided vehicle is for transfers and sightseeing as per the agreed itinerary only. Use of the vehicle for additional, off-route, or non-scheduled sightseeing must be arranged with the company in advance and may be chargeable.
- AC Usage: The vehicle's air conditioning will not operate in hilly areas or when the vehicle is stationary to prevent overheating and engine strain.
- Driver's Hours & Conduct: The driver's duty is typically for 12 hours a day. Services beyond this duration require prior notification. Drivers will not drive in "No-Entry" zones or on roads deemed unsafe or unsuitable for the vehicle. In many hill stations, driving after sunset is restricted for safety reasons.
- Pick-up/Drop-off: The tour includes one designated pick-up and drop-off point. Multiple points must be specified and agreed upon during the booking conversation.
- Vehicle Issues: In case of a major technical breakdown, we will arrange a replacement vehicle as quickly as possible. For minor issues, the vehicle will be repaired. We request your cooperation in such circumstances.
- Parking & Access: At some tourist locations, vehicle parking may be located at a distance from the sightseeing point. Guests will need to walk or use local transport to cover this distance at their own expense. Similarly, many market/mall roads have "No Entry" restrictions, requiring guests to use local transport at an additional cost.
- Vehicle Substitution: Tours Club India reserves the right to provide a vehicle of a similar category if the booked vehicle is unavailable for any reason.
4. Itinerary & Route
- Itineraries are planned to cover all mentioned sightseeing points together. Changes to the destination or route are not permitted without prior discussion with the company, and rates may change accordingly.
- No refunds will be issued for any sightseeing points missed or facilities not utilized by the guest.
5. Pricing & Payments
- Fuel Price Fluctuation: Tour rates are subject to change if there is a significant (more than 5%) increase in fuel prices in India from the time of booking. This increase may be applied even to confirmed bookings.
- Right to Cancel: The management reserves the right to cancel any service or booking without a refund if the full advance payment has not been received by the stipulated date.
6. Cancellations & Force Majeure
No cancellation or refund will be made for circumstances beyond our control. Such circumstances, known as Force Majeure events, include but are not limited to:
- Natural disasters (bad weather, landslides, heavy snowfall, earthquakes)
- Political or national crisis (war, strikes, acts of terrorism, government-imposed restrictions, blockades)
- Transportation issues (accidents, technical problems, breakdowns, flight/train cancellations)
- Any other unforeseen operational issues, business exigencies, or events that prevent us from fulfilling our obligations.
Tours Club India shall not be responsible for any delays, alterations to the program, or expenses incurred due to such events.
7. Limitation of Liability
- Tours Club India acts only as a booking agent for hotels, transporters, and other service providers. We are not responsible for any personal injury, death, accident, or theft of property that may occur during the tour.
- The company reserves the right to change the features or functionality of its services at any time, without notice.
8. Jurisdiction
Tours Club India considers itself and intends to be subject only to the jurisdiction of the courts of Haridwar, Dehradun, Uttarakhand, India. All disputes arising from this contract shall be settled exclusively in these courts.
